AIToolFB Marketing AI Terms of Service

1. Introduction
This Terms of Service (the "Agreement") is a legal agreement between AIToolFB Inc. ("AIToolFB", "we", "our", or "us") and you, the user ("Business", "you", or "your"). It governs your access to and use of AIToolFB's Marketing AI Services provided through our platform extension for Facebook interaction.
By using the AIToolFB Services, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use our Services.
2. Description of Services
AIToolFB provides a Marketing AI platform that integrates with Facebook to deliver marketing automation, AI-driven ad management, and analytics for businesses. Our services include, but are not limited to, Facebook ad creation, campaign optimization, and performance tracking powered by artificial intelligence.
The AIToolFB platform offers an extension through Facebook's API, allowing businesses to interact with potential customers effectively using automated, AI-powered tools.
3. Eligibility and Account Registration
To use the AIToolFB Services, you must register for an account. By creating an account, you certify that:
You are at least 18 years of age.
You have the legal authority to bind your organization (if applicable) to the terms of this Agreement.
All information you provide is accurate, complete, and up-to-date.
You agree to maintain the security and confidentiality of your account credentials, and are solely responsible for all activities under your account.
4. Access to the Services
You may access the AIToolFB Services through the platform’s extension for Facebook interaction. Access to the Services requires compatible hardware, software, and internet connection. We may provide updates or modifications to the platform periodically.
You agree not to use the Services for any unlawful purpose or to circumvent security measures. Unauthorized access to or use of the Services is prohibited.
5. License Grant
AIToolFB grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services in accordance with this Agreement. You may use the platform to:
Create and manage marketing campaigns via Facebook.
Analyze campaign performance.
Use AI-driven tools to optimize marketing strategies.
You may not copy, distribute, or modify the Services except as expressly permitted under this Agreement.
6. Responsibilities of the User
As a user of the AIToolFB Services, you are responsible for:
Complying with all applicable laws and regulations.
Ensuring the content you upload is lawful and does not infringe upon the rights of others.
Protecting your account credentials and notifying AIToolFB immediately of any unauthorized access or security breaches.
7. Service Availability
AIToolFB makes no guarantees regarding the availability of the Services at all times. The Services may experience downtime for maintenance, updates, or other unforeseen issues.
You are responsible for maintaining backup copies of your data, as AIToolFB is not responsible for the loss of any data or content.
8. Data Privacy and Security
AIToolFB takes your privacy seriously and will handle your data in accordance with our Privacy Policy (available at AIToolFB.com/privacy). By using our Services, you consent to the collection, processing, and storage of your data as outlined in the Privacy Policy.
You are responsible for ensuring any personal data or business information shared through the platform complies with relevant data protection laws.
9. Content Ownership and Use
You retain ownership of all content you upload, submit, or share through the AIToolFB Services ("Business Content"). However, by using the Services, you grant AIToolFB a non-exclusive, royalty-free, worldwide license to use, store, and analyze your Business Content for the purpose of providing and improving the Services.
AIToolFB may use anonymized or aggregated data to improve its AI algorithms and marketing tools.
10. Restrictions on Use
You agree not to:
Engage in any activity that could harm or disrupt the functionality of the AIToolFB platform.
Use the platform to create fraudulent or misleading content.
Reverse engineer, decompile, or attempt to extract the source code of the Services.
Violations of these restrictions may result in the suspension or termination of your access to the Services.
11. Payment Terms
Some features of the AIToolFB Services may be available for a fee. You agree to pay all applicable fees in a timely manner. AIToolFB reserves the right to modify its pricing at any time.
If you fail to pay any fees when due, AIToolFB may suspend or terminate your access to the Services.
12. Termination of Services
AIToolFB may terminate your access to the Services if:
You violate any terms of this Agreement.
You fail to make payments on time.
AIToolFB decides to discontinue the Services.
Upon termination, you must cease all use of the Services, and AIToolFB may delete or retain your data as required by law or its Privacy Policy.
13. Limitation of Liability
To the maximum extent permitted by law, AIToolFB will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Services.
AIToolFB’s total liability under this Agreement will not exceed the amount you have paid for the Services during the past 12 months.
14. Indemnification
You agree to indemnify and hold harmless AIToolFB, its affiliates, employees, and agents from any claims, damages, or expenses arising out of your use of the Services, including but not limited to violations of this Agreement or infringement of third-party rights.
15. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the jurisdiction in which AIToolFB operates. Any disputes will be resolved through binding arbitration, and you agree to submit to the exclusive jurisdiction of the courts in that jurisdiction.
16. Amendments to Terms of Service
AIToolFB reserves the right to amend or modify this Agreement at any time. You will be notified of any material changes, and your continued use of the Services constitutes your acceptance of the updated terms.
17. Miscellaneous
This Agreement constitutes the entire understanding between you and AIToolFB regarding the Services. If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
